1. The auction organization BELGIAN ELITE AUCTION is not a party to the purchase/sale transaction involving the horse offered for sale. BELGIAN ELITE AUCTION acts as an auction service provider. The auction committee acts as an intermediary between the SELLER and the buyer. The organization, preparation, and conduct of the auction are determined exclusively by BELGIAN ELITE AUCTION. This means, among other things, that BELGIAN ELITE AUCTION determines the course of events prior to and during the auction and has the authority to refrain from auctioning one or more lots, to refuse to accept a bid and declare it invalid, and to suspend, resume, extend, or cancel the auction and/or take any other measures it deems necessary.
2. The BUYER/SELLER declares that they have read these auction terms and conditions and agree to them. The BUYER/SELLER accepts all obligations inherent to an online auction, even if these are not explicitly mentioned in this agreement.
3. The SELLER agrees that his name or business name, as breeder and/or SELLER, will be listed on the auction’s website.
4. The buyer wishing to bid online must register via the auction organization's website in the prescribed manner on the auction website before he can participate in the auction. This registration constitutes unconditional acceptance of the auction terms and conditions. Furthermore, by participating in an auction, the buyer declares to be authorized to perform legal acts and declares himself authorized to conclude a purchase agreement regarding the horse in question. The auction organization reserves the right to refuse registration and participation in an auction at any time or to terminate it unilaterally. Upon first request from the auction organization, the buyer must present valid proof of identity, failing which the buyer may not participate in the auction. The buyer is obliged to ensure that all information to be provided by the bidder to the auction organization upon registration is completed fully, correctly, and truthfully, and the buyer guarantees the accuracy and completeness of the information provided by him. Should this information change at any time, the buyer is obliged to immediately notify the auction organization of these change(s). The username and password used by the buyer for an auction are strictly personal and may not be transferred by a buyer to third parties. If the buyer suspects that someone else knows his or her password, the bidder must notify the auction organization immediately. The buyer is liable for and bound by all transactions taking place at an auction resulting from the use of his/her password and/or username, including in the event of misuse if the buyer has handled his/her username and password negligently.
The buyer is aware of and expressly agrees that the services available via the website are limited to technically enabling the following of the auction via the internet and participating in the auction as a bidder. The auction organization has and assumes no responsibility whatsoever for the organization and conduct of the auction via its website (for example, and without limitation: the website failing during the auction or delays in the operation of the website during the auction). The auction organization makes every effort to secure its systems against data loss and/or against any form of unlawful use and takes appropriate technical and organizational measures to this end. In his dealings with the auction organization, the buyer is obliged to adequately secure the computer and/or any other device he/she uses to access the auction website, and to protect it, as is customary, against viruses or other unlawful programs or files that may be distributed via the internet.
5. The BUYER/SELLER declares to have taken note of all obligations and costs in connection with the auction, and to accept a deduction of 12.5% (excluding VAT) of the allocation price of the horse as a contribution towards the costs of the auction organization.
6. The horses to be auctioned are sold by bidding. Bids and payments are made exclusively in EURO.
7. The auction is supervised by an auctioneer/bailiff who draws up an official report of the allocation. Participation in an auction does not automatically mean that a lot is sold to the bidder. The organization awards each of the horses to the final bidder.
8. The sale is concluded in accordance with Belgian law by means of an auction by bidding and allocation to the highest bidder after payment of the settlement amount, whether or not increased by VAT.
9. If the buyer has not made full payment within 5 working days after being invited to do so by the auction organization, the seller has the option to consider the purchase dissolved by operation of law at the expense of the buyer without prior notice of default, with the option for the auction organization to charge the buyer a fixed compensation of 20% (excluding VAT) on the settlement amount, if applicable.
10. The private buyer/consumer purchasing online at this auction has a right of withdrawal of 14 days. The initial buyer who validly withdraws is obliged to pay the auction organization the costs associated with this resale, or at least the difference in the purchase price that was not realized during the resale.
11. The auction organization will attempt to collect the amount due from the buyer after the auction. However, the auction organization is not responsible for the collection nor can be held liable if such collection proves impossible for any reason whatsoever. The SELLER expressly acknowledges and accepts that the auction organization is not liable for the possible inability to ascertain the identity of the buyer, nor for non-payment by the buyer. If the SELLER is subject to VAT, he is obliged to issue a VAT invoice in the name of the buyer.
12. The auction organization has the right to refuse the auction of a horse if the horse shows diseases or defects during a clinical examination before or at the time it is to be auctioned. The decision regarding this rests with the veterinarian appointed by the auction organization. The examination report and the X-ray images (if applicable, from 18 months old) can be provided upon first request. In any event, the SELLER remains solely responsible for any hidden defects or defects of the horses offered for sale that render the sale void. BELGIAN ELITE AUCTION cannot be held liable for defects, whether hidden or not, that the horse may exhibit. The SELLER indemnifies BELGIAN ELITE AUCTION against any claim that may be brought against it by the buyer or its legal successor(s).
13. The BUYER/SELLER is enabled by BELGIAN ELITE AUCTION to take out insurance via, for example, Q & O HORSE.
14. The transfer of risk takes place immediately upon allocation following the conclusion of the auction.
15. After the online auction, the buyer and SELLER shall make arrangements for delivery by mutual agreement (such agreements must be made taking into account all risks and in the interest of the animal). A nursing foal is best delivered after it has been weaned. A surrogate mare must be returned to the SELLER unless different agreements have been made in this regard.... 16. The information stated in the auction catalogue and/or shown in the video footage is purely informative and serves to provide an impression of the qualities of the horse being offered. BELGIAN ELITE AUCTION has no intention whatsoever of providing guarantees to the buyer and/or the SELLER. BELGIAN ELITE AUCTION is not liable for any printing errors and/or material errors in the auction catalogue and/or in the video footage.
17. The horses (that are older than 4 years and ridden) being auctioned may be subject to a test ride, for which the buyer can make a prior appointment via BELGIAN ELITE AUCTION.
18. Neither the SELLER nor the buyer can derive any rights from the fact that the auction organization has selected the horses and that they have been examined by a veterinarian.
19. In the event of a dispute, the board of BELGIAN ELITE AUCTION makes a binding decision. In the event of unlawful non-compliance with this decision, the courts of Ghent shall have exclusive jurisdiction. Belgian law shall apply to the relationship between the parties.
20. In the event of a dispute, the Dutch text shall apply exclusively.
1. De veilingorganisatie BELGIAN ELITE AUCTION is geen partij bij de koop-/verkooprelatie van het te koop aangeboden paard. BELGIAN ELITE AUCTION treedt op als veilingdienst. Het veilingcomité treedt op als tussenpersoon tussen VERKOPER en koper. De organisatie, voorbereiding en uitvoering van de veiling worden uitsluitend door BELGIAN ELITE AUCTION bepaald. Dit betekent onder andere dat BELGIAN ELITE AUCTION de gang van zaken voorafgaand aan en tijdens de veiling bepaalt en de bevoegdheid heeft om, één of meer kavels niet te veilen of, een bod niet te erkennen en ongeldig te verklaren en de veiling te schorsen, te hervatten, te verlengen of af te gelasten en/of andere naar haar oordeel noodzakelijke maatregelen te nemen.
2. De KOPER/VERKOPER verklaart kennis te hebben genomen van deze veilingvoorwaarden en verklaart deze veilingvoorwaarden te aanvaarden. De KOPER/VERKOPER aanvaardt alle verplichtingen die eigen zijn aan een online veiling, ook als deze niet expliciet vermeld werden in deze overeenkomt.
3. De VERKOPER gaat ermee akkoord dat zijn naam of firmanaam als fokker en/of VERKOPER op de website van de veiling wordt vermeld.
4. De koper die online wenst te bieden dient zich via de website van de veilingorganisatie te registreren op de voorgeschreven wijze op de veilingwebsite alvorens hij kan deelnemen aan de veiling. Deze registratie geldt als onvoorwaardelijke aanvaarding van de veilingvoorwaarden. Verder verklaart de koper door deelname aan een veiling bevoegd te zijn tot het verrichten van rechtshandelingen en verklaart de koper zich bevoegd tot het sluiten van een koopovereenkomst met betrekking tot het betreffende paard. De veilingorganisatie behoudt zich het recht voor om de registratie en deelname aan een veiling op elk moment te weigeren of eenzijdig te beëindigen. Op eerste verzoek van de veilingorganisatie dient de koper een geldig identiteitsbewijs te overleggen, bij gebreke waarvan de koper niet mag deelnemen aan de veiling. De koper is verplicht ervoor te zorgen dat alle door de bieder aan de veilingorganisatie te verstrekken informatie bij inschrijving volledig, juist en naar waarheid is ingevuld en de koper staat in voor de juistheid en volledigheid van de door hem verstrekte informatie. Mocht deze informatie op enig moment wijzigen, dan is de koper verplicht de veilingorganisatie onmiddellijk van deze wijziging(en) op de hoogte te stellen. De gebruikersnaam en het wachtwoord die door de koper voor een veiling worden gebruikt, zijn strikt persoonlijk en mogen door een koper niet aan derden worden overgedragen. Als de koper vermoedt dat iemand anders zijn of haar wachtwoord kent, moet de bieder de veilingorganisatie hiervan onmiddellijk op de hoogte stellen. De koper is aansprakelijk voor en gebonden aan alle transacties die plaatsvinden op een veiling en die voortvloeien uit het gebruik van zijn / haar wachtwoord en / of gebruikersnaam, ook in geval van misbruik indien de koper onzorgvuldig is omgegaan met zijn / haar gebruikersnaam en wachtwoord.
De koper is zich er van bewust en stemt er uitdrukkelijk mee in dat de via de website beschikbare diensten beperkt zijn tot het technisch mogelijk maken van het via het internet volgen van de veiling en het als bieder participeren aan de veiling. De veilingorganisatie heeft en neemt geen enkele verantwoordelijkheid voor de organisatie en het verloop van de veiling via haar website (bijvoorbeeld en zonder limitatief te willen zijn: het uitvallen van de website tijdens de veiling of de vertraging van de werking van de website tijdens de veiling). De veilingorganisatie stelt alles in het werk om haar systemen te beveiligen tegen verlies van gegevens en / of tegen enige vorm van onrechtmatig gebruik en treft hiertoe passende technische en organisatorische maatregelen. In zijn omgang met de veilingorganisatie is de koper verplicht om de computer en / of elk ander apparaat dat hij / zij gebruikt om toegang te krijgen tot de veilingwebsite adequaat te beveiligen, en zoals gebruikelijk te beschermen tegen virussen of andere onwettige programma's of bestanden die kunnen verspreid via internet.
5. De KOPER/VERKOPER verklaart kennis te hebben genomen van alle verplichtingen en onkosten in verband met de veiling, en een inhouding van 12,5 % (ex btw) van de toewijzingsprijs van het paard als bijdrage in de onkosten voor de veilingorganisatie te aanvaarden.
6. De te veilen paarden worden bij opbod verkocht. De biedingen en de betalingen geschieden uitsluitend in EURO.
7. De veiling staat onder toezicht van een veilingmeester/gerechtsdeurwaarder dewelke een proces-verbaal van de toewijzing opmaakt. Deelname aan een veiling betekent voor een bieder niet dat een kavel zonder meer aan de bieder wordt verkocht. De organisatie gunt elk van de paarden aan de laatste bieder.
8. De verkoop komt tot stand volgens Belgisch recht door middel van veiling bij opbod en toewijzing aan de hoogste bieder na betaling van het afrekeningsbedrag al dan niet te verhogen met BTW.
9. Indien de koper binnen de 5 werkdagen na daartoe te zijn uitgenodigd door de veilingorganisatie de algehele betaling niet voldaan heeft, heeft de verkoper de mogelijkheid om zonder voorafgaande ingebrekestelling de koop van rechtswege als ontbonden te beschouwen lastens de koper, met de mogelijkheid voor de veilingorganisatie om desgevallend een forfaitaire schadevergoeding van 20% (ex btw) op het afrekeningsbedrag bij de koper in rekening te brengen.
10. De particuliere koper/consument die op deze veiling online aankoopt beschikt over een herroepingsrecht van 14 dagen. De initiële koper die geldig herroept, is gehouden tot betaling aan de veilingorganisatie van de kosten dewelke met deze wederverkoop gepaard gaan, minstens is deze gehouden tot het verschil in de koopprijs dewelke tijdens de wederverkoop niet gerealiseerd werd.
11. De veilingorganisatie zal proberen het verschuldigde bedrag na de veiling van de koper te innen. De veilingorganisatie is echter niet verantwoordelijk voor de inning dan wel kan niet aansprakelijk worden gehouden indien deze inning om welke reden dan ook niet mogelijk blijkt. De VERKOPER erkent en aanvaardt uitdrukkelijk dat de veilingorganisatie niet aansprakelijk is voor het mogelijk niet kunnen achterhalen van de identiteit van de koper, noch voor wanbetaling vanwege de koper. Indien de VERKOPER BTW-plichtig is, is hij gehouden om een BTW-factuur op naam van de koper op te stellen.
12. De veilingorganisatie heeft het recht om de veiling van een paard te weigeren indien het paard bij klinisch nazicht ziektes of gebreken vertoont voordat of op het moment dat ze geveild zouden moeten worden. De beslissing hierover berust bij de door de veilingorganisatie aangestelde dierenarts. Het verslag van de keuring en de RX-beelden (desgevallend vanaf 18 maanden oud) kunnen op eerste verzoek overgemaakt worden. Hoe dan ook blijft de VERKOPER de enige verantwoordelijke voor eventuele verborgen of koopvernietigende gebreken van de te koop aangeboden paarden. BELGIAN ELITE AUCTION kan niet aansprakelijk gesteld worden voor gebreken, al dan niet verborgen, dewelke het paard zou vertonen. De VERKOPER vrijwaart BELGIAN ELITE AUCTION voor elke vordering dewelke door de koper of haar rechtsopvolger(s) lastens haar zou worden ingesteld.
13. De KOPER/VERKOPER wordt door BELGIAN ELITE AUCTION in de mogelijkheid gesteld om een verzekering af te sluiten via bijvoorbeeld Q & O HORSE.
14. De risico-overdracht heeft onmiddellijk plaats vanaf de toewijzing na afloop van de veiling.
15.Na de online veiling treffen koper en VERKOPER in onderling overleg de schikkingen voor de levering (dergelijke afspraken moeten gemaakt worden rekening houdende met alle risico’s en in het belang van het dier). Een veulen dat zoogt, wordt best geleverd na gespeend te zijn. Een dragermerrie moet geretourneerd worden aan de VERKOPER tenzij afwijkende afspraken desbetreffend ….
16. De informatie dewelke vermeld wordt in de veilingcatalogus en/of getoond wordt op de videobeelden is louter informatief en strekt er toe een indruk te geven over de kwaliteiten van het paard dat aangeboden wordt. Geenszins heeft BELGIAN ELITE AUCTION de intentie aan de koper en/of aan de VERKOPER garanties te verstrekken. BELGIAN ELITE AUCTION is niet aansprakelijk voor gebeurlijke drukfouten en/of materiële vergissingen in de veilingcatalogus en/of op de videobeelden.
17. De paarden (die ouder zijn dan 4 jaar en bereden zijn) die geveild worden kunnen onderworpen worden aan een testrit waarvoor de koper een voorafgaandelijke afspraak kan maken via BELGIAN ELITE AUCTION.
18. Noch de VERKOPER noch de koper kunnen enig recht ontlenen aan het feit dat de veilingorganisatie de paarden heeft geselecteerd en dat deze door een dierenarts zijn onderzocht.
19. In geval van betwisting beslist het bestuur van BELGIAN ELITE AUCTION bindend. Bij een onrechtmatig niet-nakomen van deze beslissing, zijn uitsluitend de rechtbanken van Gent bevoegd. Het Belgisch recht is van toepassing op de relatie tussen partijen.
20. Bij betwisting geldt uitsluitend de Nederlandse tekst.
