Belgian Elite Auction – Auction – August 8, 2025 – Vosselare (Belgium)
Scope of Application
1. BELGIAN ELITE BV is a company with its registered office at Zeemansdreef 15, 8670 Koksijde, Belgium. It can be reached by phone at

info@belgianelite.auction), and is registered with the Belgian company register under number BE 0790586325. BELGIAN ELITE BV is organizing a live auction for (jumping) horses and foals which will conclude on 08.08.2025.
2. Participation in the auction implies knowledge and explicit and unconditional acceptance of these auction terms and conditions.
3. BELGIAN ELITE BV sells (jumping) horses and foals through its auction on behalf and for the account of third parties. BELGIAN ELITE BV acts as the auction service. The auction committee acts as an intermediary between seller and buyer.
5. Furthermore, by participating in the auction, the buyer declares to be authorized to perform legal acts and confirms being authorized to enter into a purchase agreement. Upon first request, the buyer must present a valid proof of identity, failing which they may not participate in the auction. The buyer is obliged to ensure that the information provided during registration is complete, correct, and truthful. The username and password used by the buyer for an auction are strictly personal and may not be transferred to third parties. The buyer is liable for and bound by all transactions that occur at an auction resulting from the use of their password and/or username, even in cases of misuse.
6. The buyer acknowledges that the services available via the website are limited to the technical facilitation of following the auction online and participating as a bidder. BELGIAN ELITE BV bears and assumes no responsibility for the organization and conduct of the auction via the website [

7. The lots are auctioned in the condition they are in at the time of the auction.
8. The sale is concluded under Belgian law through auction and allocation to the highest bidder after payment of the settlement amount, possibly increased by VAT. The auction is supervised by an auctioneer appointed by the auction organization, who will draw up a report of the allocation.
9. Bidding and payments are made in EURO.
10. A bid must be made in the manner indicated by the organization. The foal auction starts at four thousand euros (4,000.00 EUR), the auction of young horses (free jumpers) starts at seven thousand five hundred euros (7,500.00 EUR), and the auction of ridden horses starts at fifteen thousand euros (15,000 EUR). A bid must be increased by at least five hundred euros (500.00 EUR); once the amount of ten thousand euros (10,000.00 EUR) is reached, each bid must increase by a minimum of one thousand euros (1,000.00 EUR). When the amount of twenty thousand euros (20,000.00 EUR) is reached, each bid must increase by at least two thousand euros (2,000.00 EUR). The organization may, at any time during the auction, change the manner in which the auction is conducted. The organization is entitled to reject any bid if, in its judgment, there are reasonable grounds to do so.
11. If a Bidder places a Bid, that Bid shall be considered an offer to the Seller. A Bidder is bound by a Bid that is deemed irrevocable and unconditional. Every Bidder who places a Bid is considered to bid on their own behalf and is personally bound to the auction organization and (after allocation) to the Seller for all obligations arising from their Bid. This applies even if the Bidder states they are acting on behalf of a third party. If several persons declare to make or have made a Bid jointly, they shall be jointly and severally liable for the obligations arising therefrom to the organization and (after Allocation) to the Seller.
12. A Bidder with the second-highest Bid is obliged to honor their Bid for 14 days after the auction in case the highest Bid is declared invalid or not honored, for example, because the relevant Bidder fails to meet their obligations in whole or in part, or because the purchase agreement with the relevant Bidder does not materialize for another reason.
Prices
13. Unless explicitly stated otherwise with respect to the Bidder, the listed prices are exclusive of VAT.
14. The Bidder shall owe the auction organization an additional twelve and a half percent (12.5%) of the purchase price, exclusive of VAT, as commission and for auction-related costs. These auction costs must in any case be paid before the delivery of the horse to the buyer to the account of BELGIAN ELITE BV.
15. In addition to the fixed costs mentioned in article 13, the Bidder must also pay VAT on the purchase price if so indicated.
16. The horses are allocated to the highest bidder. By placing a bid, the bidder commits to paying the settlement amount, unless a higher bid is placed afterward.
Payment
17. All invoices must be paid within a period of three (3) working days from the invoice date.
Risk and Delivery
18. All liability for the auctioned horses and foals transfers to the Buyer from the moment of allocation after the auction. After the auction and after full payment of the settlement amount, the buyer and seller will make arrangements for the delivery by mutual agreement. The purchase agreement is concluded between buyer and seller, whereby the seller – and not the auction organization – is liable for any defects the horses may have after the auction.
19. Ownership of the horses transfers at the moment of payment of the settlement amount by the Buyer to the organization and the seller.
20. Unless specifically discussed otherwise, when purchasing an embryo, the surrogate mother (carrying the embryo) is automatically sold along with it for an additional price of 3,000 euros (excl. 21% VAT) on top of the embryo price. Ownership of the surrogate mother transfers at the moment of payment by the buyer to the auction organization.
21. Delivery of the Item occurs at the risk and expense of the Seller, provided the place of delivery is within Belgium. Buyer and Seller make delivery arrangements by mutual agreement, which can only take place after full payment to the organization, without prejudice to article 18.
22. Ownership of the horses transfers at the moment of payment by the buyer to the auction organization.
23. Neither the seller nor the buyer can derive any rights from the fact that the auction organization selected the horses and, if applicable, subjected them to a veterinary examination at its request. Prior to selection and auction, the horses underwent a veterinary inspection. Reports and X-ray images will be provided by email upon first request to interested parties. For further questions regarding the veterinary examination, interested parties can contact the appointed veterinarian.
24. The information regarding the horses is only intended to provide an impression of the qualities of the offered horses, without the intention of being complete or providing guarantees. The auction organization is dependent on information provided by the seller or third parties when describing a lot. The auction organization is not liable for any typographical errors and/or material mistakes on its website and in the catalog.
25. Height and physical characteristics:
The heights of the horses listed are based on information provided by the sellers and are for informational purposes only. The auction organization does not take its own measurements and does not guarantee the accuracy or precision of these measurements. In addition, in the case of young horses, these measurements may be a snapshot in time; the final adult height may differ from this. The stated height measurements do not give rise to any form of liability, and no rights can be derived from them.
26. The buyer has the opportunity, by appointment, to make a test ride on the ridden horses to be auctioned prior to the auction. The test ride takes place at the location designated by the auction organization and is conducted within the limits set by the auction organization in consultation with the seller.
27. In the case of export, the buyer must present a valid export document to the seller within a period of 3 months, under penalty of the seller charging the applicable VAT retroactively.
28. In case of contractual default, bankruptcy, or manifest insolvency of the Buyer, the organization may consider the agreement terminated by law and without prior notice by means of a simple registered letter. In case of dissolution or termination of the agreement at the expense of the Buyer, the Buyer shall owe the Company a fixed compensation of 25% of the price to be invoiced under the Agreement, without prejudice to the compensation of the actual damage incurred by the Company.
29. In case of disputes between the auction organization and participants in the auction (buyer or seller), or between the buyer and seller, only the Dutch version of these terms and conditions is legally binding. The translation of these auction terms into another language is purely informative.
30. The auction organization has the final say in resolving any disputes that may arise during the auction proceedings concerning the sale.
31. Any dispute arising from this auction and its consequences shall be governed exclusively by Belgian law, excluding the provisions of the Vienna Convention on the International Sale of Goods. The Court of First Instance of East Flanders, Ghent division, and the Commercial Court of Ghent, Ghent division, shall have exclusive jurisdiction to hear any disputes.
